If you take a blood alcohol test, and the results of the BAC exceeds 0.05 but is less than 0.08, there is "permissible inference" that you were driving while ability impaired (DWAI). If the results indicate your BAC is 0.08 or more, there is "permissible inference" that you were driving under the influence (DUI).
